General Terms & Conditions Ultiem Airsoft

1. Definitions
In these terms and conditions, the following definitions apply:
1.1 Entrepreneur: Ultiem Airsoft, located at Dijkwacht 76, 2353EK Leiderdorp, registered with the Chamber of Commerce under number 96146109.
1.2 Customer: the natural or legal person entering into an agreement with the entrepreneur.
1.3 Agreement: any agreement between the entrepreneur and the customer, including distance contracts concluded via the website.
1.4 Products: all goods and/or services offered by the entrepreneur.
1.5 Right of withdrawal: the customer’s right to cancel a distance agreement within the statutory cooling-off period.
1.6 Written: communication via email, post, or other written means mutually agreed upon as valid.

2. Applicability
2.1 These terms and conditions apply to all offers, quotations, orders, agreements, and deliveries by Ultiem Airsoft.
2.2 Deviations from these terms are only valid if agreed upon in writing.
2.3 If any provision is invalid or void, the remaining provisions remain fully in effect.

3. The Offer
3.1 Ultiem Airsoft’s offer is non-binding and may be changed or withdrawn at any time.
3.2 The offer provides a complete and accurate description of the products, including features, prices, and any additional costs.
3.3 Obvious errors, typos, or technical issues in the offer do not bind the entrepreneur.

4. Formation of the Agreement
4.1 The agreement is concluded when the customer places an order via the website and it is confirmed by Ultiem Airsoft.
4.2 Ultiem Airsoft reserves the right to refuse an order, for example, in case of doubt about the accuracy of the provided information or payment issues.
4.3 For accepted orders, Ultiem Airsoft sends a confirmation to the email address provided by the customer.

5. Prices and Payment

5.1 All prices on the website are in euros, including VAT, unless stated otherwise.
5.2 Any additional costs, such as shipping or administrative fees, are clearly stated before placing the order.
5.3 Payment must be made via the offered methods, such as iDEAL, credit card, PayPal, or other accepted methods.
5.4 In case of late payment, Ultiem Airsoft reserves the right to suspend or cancel delivery.

6. Delivery and Execution

6.1 Ultiem Airsoft strives for careful processing and delivery of orders.
6.2 Orders are delivered to the address provided by the customer. The customer is responsible for providing accurate and complete address details.
6.3 Delivery times are indicative and do not entitle the customer to compensation if exceeded.
6.4 If a product is out of stock or delivery is delayed, the customer will be informed as soon as possible.

7. Right of Withdrawal
7.1 The customer has the right to withdraw from the agreement within 14 days after receiving the order without giving any reason.
7.2 During the withdrawal period, the customer must handle the product and packaging carefully. Returned products must be in their original condition and packaging.
7.3 To exercise the right of withdrawal, the customer must send a written notice to Info@ultiem-airsoft.nl including the order number and the products to be returned.
7.4 The customer bears the cost of returning the products unless otherwise agreed.
7.5 Ultiem Airsoft will refund the purchase price, including standard shipping costs, within 14 days of receiving the returned products.

8. Exclusion of Right of Withdrawal
8.1 The right of withdrawal does not apply to:

• Products that spoil quickly or have a limited shelf life.
• Personalized or custom-made products.
• Products that cannot be returned for hygiene or health reasons once the seal is broken.

9. Warranty and Complaints
9.1 Ultiem Airsoft guarantees that the delivered products comply with the agreement, the specifications listed in the offer, and the reasonable requirements of quality and usability under the law.
9.2 All products are covered by statutory warranty. This means the product must meet what a consumer can reasonably expect. The duration of this warranty is not fixed and varies per product, with a practical minimum of two years, without prejudice to the consumer’s legal rights.
9.3 Additional manufacturer’s warranties may apply, which are offered by the manufacturer or importer. These vary by product and do not affect the consumer’s statutory rights.
9.4 Warranty is void in case of:

• Damage from improper or careless use
• Normal wear and tear
• Modifications or repairs by third parties without Ultiem Airsoft’s permission

9.5 Complaints must be reported in writing to Ultiem Airsoft within 7 days of receipt.
9.6 Ultiem Airsoft aims to respond in writing within 3 business days.
9.7 If a complaint is justified, Ultiem Airsoft will arrange repair, replacement, or (partial) refund at no cost, reserving the right to inspect the product first.

10. Liability
10.1 Ultiem Airsoft is only liable for direct damage caused by intent or gross negligence.
10.2 Liability is limited to the amount paid by the customer for the product.
10.3 Ultiem Airsoft is not liable for indirect damage, such as consequential damage, loss of profit, or data loss.

11. Force Majeure

11.1 Ultiem Airsoft is not liable for failure to meet obligations due to force majeure.
11.2 Force majeure includes circumstances beyond Ultiem Airsoft’s control, such as natural disasters, pandemics, strikes, or transport/communication failures.
11.3 In such cases, Ultiem Airsoft may suspend or terminate the agreement without liability for damages.

12. Intellectual Property Rights

12.1 All intellectual property rights related to the website and offered products belong to Ultiem Airsoft or its licensors.
12.2 Copying, distributing, or using materials from the website without prior written consent is prohibited.

13. Privacy and Data Protection

13.1 Ultiem Airsoft processes personal data in accordance with the General Data Protection Regulation (GDPR).

14. Applicable Law and Disputes
14.1 Dutch law applies to these terms and all agreements.
14.2 Disputes will preferably be resolved amicably; if not, they will be submitted to the competent court in the Netherlands.
